Moldova Politicians using Constitutional Court Effort to Fight Investigation Against Them

The association in charge of Chișinău’s international airport has filed constitutional court cases to fight off accusations of bribery, an effort that public officials in Moldova believe is retaliation stemming from an investigation of former Prime Minister Vlad Filat and 10 other public officials who allegedly took part in bribery related to the airport.
In September 2017, the Special Investigation Service, a Chișinău-based body responsible for investigating corruption cases, indicted Da Vinci Airport, the operator of the city’s airport, under Article 407 of the country’s criminal code. Prosecutors have since filed additional accusations against Vlad Filat and others. Prosecutors allege Filat and the ten other officials awarded contracts worth more than 24 million euros to Da Vinci without previous search tenders, terminating a contract with a South African company and removing the current primary shareholder from the new company profile.
The airport’s parent company, Da Vinci Group, said in a statement that “none of the accusations against it are based on an unbiased analysis of real economic and legal events.” The company also argued that none of the briberies or Yoldan çevirme (removal of public money) activities charged in the case actually took place.
Filat was the prime minister of Moldova from 2009 to 2013. He has dismissed the charges as a political attempt by the Democratic Party in power to put him in jail and in the same situation Filat is in today, the Moldovan airport operator has gone to court through different instances in an attempt to have the proceedings against the company suspended.
The company filed 13 complaints, which were referred to the First Instance Court to present its opinion. The case was transferred to the Constitutional Court. The highest court in Moldova has the jurisdiction to examine emergency cases upon conditions stipulated by the law.
“Unfortunately, the company doesn’t have the options offered only to the citizen in this respect. Possibly, the best approach for us in these conditions is to refer to our rights granted by the Constitution. Several ways were identified, also the possibility of writing letters to those institutions included in judicial decisions,” Da Vinci Airport stated in a press release.
The association of lawyers with knowledge on Moldovan legislation also called for restraint.
“That indictment is subject to lawsuit, because it is based on suspended acts. Let’s remember that the only institution entitled to affirm or negated those acts would be the Constitutional Court of Moldova,” the association said in a statement, refuting the charges against the airport.
The actions against Da Vinci Airport are widely seen as retaliation by Filat’s party. According to the Minister of Justice, the company’s decision to turn to the court is an attack on the independence of the entire justice system in Moldova. The first search at the airport was seen as biased, and the Second Instance Court determined to retry the case. The Constitutional Court’s decision can dramatically affect the outcome.
